Death Caused by Infectious Disease Presumption Case

AOE/COE (Arising Out of Employment / Course of Employment) is the term used to describe the criteria that must be proven or disproven in a workers' compensation claim to determine whether an injury or illness is work-related or not. Proving that a death was caused by a work-related situation can be challenging. Our firm has extensive experience handling catastrophic injuries and illnesses, successfully proving they were work-related, and obtaining maximum benefits for the surviving family members.

In one case, a California worker represented by Just Solution Law Group, APC contracted COVID-19 during the pandemic, which ultimately led to their death. The defendant argued that no specific event or evidence proved the virus was contracted at the workplace, and they attempted to obstruct our investigation. However, our firm was able to obtain critical records that were later submitted to a Qualified Medical Evaluator (QME) in California, who determined that the presumption of the infectious disease was linked to the worker’s job activities. The defendant was unable to provide sufficient evidence to counter this conclusion or support their denial.
